What other types of leaves exist apart from vacations in Mexico?

In Mexico, employees are entitled to various types of leave, including sick leave, disability leave, maternity leave, paternity leave, and unpaid leave, all supported by the Federal Labor Law and social security system.

These provisions ensure that employees can take necessary time off without financial hardship, with social security covering much of the financial support during disability and parental leaves, relieving employers of the obligation to pay salaries during these periods. Understanding these entitlements helps ensure compliance and promotes workforce well-being.

Sick Leave

  • Certificate Requirement:
    Sick leave can be taken in the event of a health-related issue that results in a sanitary contingency declaration (“declaratoria de contingencia sanitaria”). This certificate is typically issued by health authorities to confirm the need for leave due to a public health concern or specific illness.


Disability Leave

  • Duration:
    Employees can take disability leave for up to 52 weeks.

  • Payment:
    During disability leave, employees are paid 60% of their salary by Social Security. This financial support helps employees manage their living expenses while they recover.

  • Occupational Injuries/Accidents/Diseases:
    If the disability is due to an occupational injury, industrial accident, or occupational disease, the same provisions apply—Social Security covers 60% of the employee’s salary.

  • Employer's Responsibility:
    During disability leave, the employer is not required to pay the employee's salary. The financial support is entirely managed by the social security system.


Other Types of Leave

Paid Leave

  • Maternity/Pregnancy Leave:
    Female employees are entitled to 42 days of leave for maternity or pregnancy, which is paid by Social Security. This leave is crucial for the health and well-being of both the mother and the newborn.

  • Paternity Leave (Second Parent):
    Fathers or second parents are entitled to 5 days of paternity leave following the birth of a child. This leave is also paid by Social Security, allowing the parent to support the mother and bond with the newborn.

Unpaid Leave

  • Extended Pregnancy Leave:
    In addition to the standard maternity leave, pregnant employees may take up to 4 weeks of unpaid leave. This leave can be used before or after the birth, depending on the employee’s needs and circumstances.
