What are the Paid and Unpaid Leaves in Colombia?

Colombian labor law provides several types of leave to support employees in various life situations.

Paid Leave

  1. Maternity/Pregnancy Leave:

    • Duration: 18 weeks (126 days) in total.
    • Distribution: Includes 1 week before the expected birth date, allowing mothers to prepare for delivery and rest before childbirth. The remaining 17 weeks are taken after the birth.
    • Payment: Maternity leave is paid at the full salary rate.
  2. Paternity Leave:

    • Duration: 2 weeks (14 days).
    • Eligibility: Available to the second parent (typically the father) to support the mother and bond with the newborn.
  3. Parental Leave:

    • Duration: The last 6 weeks of maternity leave can be shared between both parents.
    • Flexibility: This allows parents to distribute the leave time according to their family needs and preferences.
  4. Sick Child Leave:

    • Duration: 10 days for caring for a child with a terminal illness.
    • Purpose: Provides time for parents to care for their critically ill child.
  5. Abortion Leave:

    • Duration: 2 to 4 weeks.
    • Purpose: Offers recovery time following an abortion.
  6. Bereavement Leave:

    • Duration: 5 working days.
    • Purpose: Provides time to grieve and handle affairs following the death of a close family member.

Unpaid Leave

  1. Suffrage Leave:

    • Purpose: Employees are entitled to take time off to vote during elections. This leave is granted to ensure that employees can participate in the democratic process without compromising their employment.
  2. Military Service Leave:

    • Purpose: Employees are entitled to take leave for mandatory military service. The duration and conditions of this leave are regulated by specific military and labor laws.

In summary, Colombian labor law offers a range of leave options to support employees through significant life events, from maternity and paternity leave to bereavement and military service. These provisions ensure that employees have the necessary time and support to manage personal and family needs while maintaining job security.
