In Argentina, employers are legally required to provide employees with a minimum work-from-home allowance.

According to Telework Law No. 27,555 and its regulatory decree, employers must comply with the following requirements regarding equipment and expense coverage:

  • Provision of equipment: the employer must provide the necessary hardware, software, tools, and technical support for the proper performance of the job.

  • Maintenance and reimbursement: the employer must bear the costs of installation, maintenance, and repair of such tools, or alternatively, reimburse the employee for using their own equipment.

  • Employee responsibility: the employee must ensure the proper use and care of the equipment and prevent its use by third parties.

  • Normal wear and tear: the employee is not responsible for the normal wear of tools caused by use or over time.

  • Replacement or repair: in the event of damage or malfunction preventing the employee from working, the employer must replace or repair the equipment. The time required to do so does not affect the employee’s right to receive their regular salary.

  • Non-salary nature: the provision of equipment and reimbursement of related expenses are non-remunerative, meaning they are not included in the salary base for the calculation of labor or social security contributions.

This allowance is designed to help cover expenses related to remote work, such as:

  • Internet costs
  • Electricity bills
  • Other home office essentials

Ensuring this allowance is paid in full and on time is essential for compliance with local regulations.
