What is the employee and employer notice period in Latvia?

In Latvia, the statutory notice period for an employee resigning from their role is 1 month, as outlined in Section 100 of the Labour Law (Darba likums).

Can a longer notice period be included in the contract?
Yes, a longer notice period may be specified in the employment contract. However, Latvian law allows an employee to resign with 1 month’s notice regardless of the contractual terms. This means that:

  • An extended notice period is not legally enforceable against the employee.

  • The employee retains the right to resign with 1 month's notice, even if the contract states otherwise.

What notice period applies to employers?
For employers, the applicable notice period depends on the reason for termination. In some cases, such as redundancy or long-term incapacity, the Labour Law specifies minimum notice requirements, typically ranging from 10 days to 1 month.

  • Employers may agree to longer contractual notice periods, which can be valid and enforceable.

  • Any extended period must comply with minimum legal requirements and must not be discriminatory.

Summary:

  • Employee: Legally required to give 1 month’s notice. A longer contractual notice period is not enforceable.

  • Employer: May be subject to longer notice periods depending on the termination reason and terms of the contract. Contractual extensions can be enforceable if compliant with the Labour Law.
